Is there any limit to the Right's hypocrisy about the Constitution? Do folks like Marco Rubio, Michele Bachmann, war-on-terror architect John Yoo, and columnist Charles Krauthammer really believe the Constitution means one thing when a Republican is in the White House, and something entirely different when the President is a Democrat?

That is the only conclusion that can be drawn from the incessant and insufferable howling from conservatives that President Obama's decision to exercise prosecutorial discretion to allow studious and law-abiding young people brought to this country by their parents to remain is somehow a threat to our constitutional system of government.

First, a short historical recap. During successive Republican presidencies, conservatives have made extremely aggressive, and in some cases unsustainable, assertions about the unfettered powers of the President to enforce the law and control the Executive Branch. This started in the Reagan Administration, where young conservatives in the Justice Department and White House Counsel's office (notably including John Roberts and Samuel Alito) fashioned something known as the "unitary executive theory" as a way of trying to strike out against independent agencies and special counsels that were not fully within the power and control of the President. As a Congressional Research Service (CRS) report from 1987 put it, "[i]n support of a variety of actions since 1981 designed to ensure ultimate presidential control of decisionmaking in all executive branch agencies, the Reagan administration has articulated a constitutional based theory of a unitary executive."

The Supreme Court decisively rejected this theory in 1988 with its 7-1 opinion in Morrison v. Olson, written by Chief Justice William Rehnquist. The Reagan Administration's unitary executive argument drew support only in a lonely dissent by Justice Antonin Scalia, but it lived on in conservative circles and was resurrected in the George W. Bush Administration in the foreign policy context. Particularly in an Office of Legal Counsel memorandum written by John Yoo authorizing warrantless wiretapping, President Bush asserted inherent powers to ignore federal statutes and even constitutional prohibitions such as the Fourth Amendment's ban on unreasonable searches and seizures when necessary to conduct the worldwide war on terror.

Compared to these truly aggressive assertions of executive authority, President Obama's new immigration policy is presidential child's play. More precisely, President Obama has done what Presidents can and should do in honoring their Article II obligation to "take care that the laws are faithfully enforced." At the core of executive authority is prosecutorial discretion, which allows the Executive Branch latitude in determining how to allocate its resources in enforcing the law. As Justice Scalia has said in an immigration case, "prosecutorial discretion" is the "special province of the Executive."

This is particularly true in the immigration context, because Congress, in the Immigration and Naturalization Act, made it clear that the enforcement of immigration laws is vested with the Executive Branch. Again, in the words of the Supreme Court, "Congress made a deliberate choice to delegate to the Executive Branch, and specifically to the Attorney General, the authority to allow deportable aliens to remain in this country in certain specified circumstances." Meanwhile, Presidents of both political parties have been using prosecutorial discretion to allow deferred actions [pdf] on deportable individuals for decades, and President Obama's new policy [pdf] still must be applied by federal officials on a case-by-case basis with no guarantees.

As Ilya Somin, a respected conservative scholar has explained, President Obama's decision not to deport certain studious and law-abiding youth brought here by their parents is akin to the decision of federal drug officials not to pursue college students who smoke pot in their dorms, and constitutional for the same basic reason. The President cannot refuse to enforce a law passed by Congress. But federal laws governing many subjects, including guns, drugs, taxes and immigration, all sweep a large number of Americans into their broad nets, and it is the responsibility, ultimately of the President, to decide who to prosecute and why.

As President Obama said, "this is not amnesty, this is not immunity. This is not a path to citizenship. It's not a permanent fix. This is a temporary stopgap measure that lets us focus our resources wisely while giving a degree of relief and hope to talented, driven, patriotic young people." Those who call this humane and lawful action unconstitutional know very little about the U.S. Constitution and nothing about what makes America great.

Procter & Gamble cuts 4Q profit, revenue outlook

NEW YORK (AP) ? Procter & Gamble Co. on Wednesday lowered its fourth-quarter earnings and revenue forecasts, the latest company to sound warning bells about slowing global economic growth.

P&G, which makes an array of everyday goods ranging from Tide detergent to Gillette razors, said it is cutting the forecast because of unfavorable foreign exchange rates, continued slow growth in developed markets and a slowdown of growth in China.

Many U.S. companies have looked to emerging markets as economic growth in North America and Europe has slowed. But P&G's and others' warnings show that expanding abroad is a complicated task for even the largest of companies.

Earlier this month McDonald's said economic volatility, particularly in Asia, is pressuring its second-quarter results. Package delivery company FedEx Corp. on Tuesday said the slowing global economy is expected to crimp its growth over the next 12 months. Its rival UPS in April similarly said slowing Asian shipments hurt quarterly results.

And a wide range of companies including software maker Adobe Systems Inc., medical device maker Synergetics USA and industrial products maker Actuant Inc. have said uncertainty in Europe and slower growth in Asia are hurting.

A few months ago, Europe's economy seemed more positive, Moody's Chief Economist John Lonski said. But that view has darkened in recent months as uncertainty over debt crises in countries such as Spain and Greece dragged on longer than expected. That in turn has led to a slowdown in emerging markets such as Brazil, India and China.

"Global growth is slower than anticipated," he said. "And though it's a stretch to predict the imminence of a global recession, the worldwide slowdown has been great enough to prompt downward revisions of revenue forecasts by multinational corporations."

P&G's cut, announced during a presentation at a Deutsche Bank Global Consumer conference in Paris, is its second in three months. The company is trying to balance growth in emerging markets, which make up about 30 percent of its sales, with the realities of an uncertain global economy and its own executional problems that have led to lackluster market share growth.

Last month P&G said it was rethinking overseas expansion and would focus on its biggest and most profitable markets abroad.

On Wednesday, CEO Bob McDonald reiterated that strategy as well as the company's cost-cutting program, aimed at saving $10 billion by fiscal 2016.

"We are making the necessary adjustments to our growth strategy to increase focus on our core business and to achieve more balanced growth across geographies, product categories and the top and bottom lines," he said in a statement accompanying the presentation.

The world's largest consumer products company said it expects adjusted fourth-quarter earnings between 75 cents and 79 cents per share, down from its previous estimate of 79 cents to 85 cents per share.

Revenue is anticipated to drop 1 percent to 2 percent compared with a prior outlook for a 1 percent to 2 percent increase. The new guidance implies revenue in a range of $20.45 billion to $20.66 billion.

Analysts polled by FactSet foresee earnings of 82 cents per share on revenue of $20.62 billion.

P&G reiterated a plan announced last month that it will prioritize investments in its biggest product innovations, its biggest and most profitable markets and its biggest emerging countries. It also plans to keep investing in new markets.

For fiscal 2013, Cincinnati-based P&G expects adjusted earnings to be up by a mid-to-high single digits percentage rate. The company said it will give an update to the projection when it reports its fiscal 2012 results on Aug. 3.

Its shares fell $1.82, or 2.93 percent, to close at $60.39 Wednesday. Its shares are down 11 percent since peaking for the past year at $67.95 in mid-March. They traded as low as $57.56 last August.

Citi Investment Research analyst Wendy Nicholson said P&G's struggle with market share growth is "discouraging," but said there were some positives in the presentation.

"P&G is clearly saying 'no excuses' and adopting a more aggressive stance about taking responsibility for and fixing their problems," she wrote in a note to investors.

Also on Wednesday, the company reaffirmed its restructuring plan, which involves cutting 5,700 jobs by the end of fiscal 2013 and saving $10 billion by the end of the fiscal 2016.

Like many other consumer products companies, P&G has also been raising prices to deal with higher costs for materials like pulp, fuel and packaging. But in April, P&G said it was rolling back prices in six categories: powdered laundry detergent in the U.S., laundry products in Mexico and the U.K., and North American oral care, dish care and blades and razors. Aside from those categories, other price increases have remained in place.

Cambridge, Mass., mayor considers large soda ban

(AP) ? The mayor of Cambridge has proposed limiting the size of soda and sugar-sweetened beverages sold in city restaurants, saying she was inspired by a similar measure in New York City.

Mayor Henrietta Davis on Monday asked the city's health officials to research her proposal and make a recommendation on limiting beverage sizes. The city is adjacent to Boston and is home to Harvard and MIT.

Davis cited an increased risk of obesity and diabetes as reasoning behind the resolution.

"As much free will as you can have in a society is a good idea," Davis said Tuesday. "... But with a public health issue, you look at those things that are dangerous for people, that need government regulation."

In New York, Mayor Michael Bloomberg's proposal would prohibit licensed food service establishments in the city from using containers bigger than 16 ounces to serve high-calorie drinks like colas.

Consumers could buy another round, but restaurants couldn't serve sugary drinks in the 20-ounce cups now popular at fast food eateries.

Davis also said regulation might not be necessary to prevent the sale of large-sized sugary beverages in Cambridge. She said city officials could pitch a voluntary compliance agreement to vendors or create an incentive program to encourage cooperation.

Davis, who also is a chair of a Cambridge community coalition that focuses on children's health, said she's been hearing mixed reactions to her resolution.

Don Puzy, the manager of a 7-Eleven in the city, on Tuesday called the mayor's proposal "absolutely crazy."

He said he sells a lot of the store's signature Big Gulps, but said it's mostly grownups who buy them.

"We appreciate her trying to do something about the kids, their weight, but that is not the way to go about it," Puzy said of the mayor's proposal. "There are a lot of programs for it ... starting from the schools ... Don't put it on the stores."

Bachelor's degree of doubt: Culinary student takes kitchen over cubicle

With the value of a bachelor's degree in doubt, paths around the traditional college degree are multiplying: Turner Jankins chose culinary school over other options.

With the value of an ordinary bachelor's degree in doubt, nontraditional career paths are increasing. Turner Jenkins had dabbled in getting college credits but chose L'Academie de Cuisine in Gathersburg, Md., to launch him on a culinary career that can earn him as much as a bachelor's would.

For four years, Turner Jenkins had waited tables and tended bar in the Washington, D.C., area, when, he says, "I decided that I don't want to be doing this my whole life."

One option was resurrecting credits from a desultory college experience ? one year at the University of Arizona, Tucson; another at Montgomery Community College in Maryland ? and going for a bachelor's.

But many of his friends who'd graduated were unemployed, while others were in fields unrelated to their studies.

"I wanted to focus on something that I loved doing and have that be my profession," he says.

And what does this 25-year-old love?

"I like good food. I like to cook. I like the smile on someone's face when they're eating it."

So Mr. Jenkins swallowed his fears and applied to L'Academie de Cuisine, a top-rated culinary school in Gaithersburg, Md. Hours are long, the pressure unrelenting, and the rules strict.

"They can say, 'Yes, chef' and 'No, chef.' There is no such thing as 'But, chef ... ' " says Barbara Cullen, a school administrator.

Jenkins, who never gave 100 percent to academics, gets to school at 6 a.m. to be in uniform when class starts at 7.

Halfway through the 12-month program, he speaks with authority about calculating food costs, devising delicious ways to use every last edible scrap, and learning how to "keep the hollandaise warm but not [so] hot that it breaks."

His next challenge is setting up a six-month externship with a respected chef. When he completes the program, Jenkins will have paid $28,000 to lay the foundations for a career in fine cuisine, where average yearly earnings start at $33,000 and can grow to $85,000-plus. From being part of the 34 to 44 percent of students who drop out of college, Jenkins could become part of the 27 percent who, without any degree, earn more than the average bachelor's degree holder.

Mache Seibel, MD: Father's Day Song -- My Old Man

My father, Tony Seibel, was a first generation American, born to immigrant parents who came to the United States for a better life. Dad became an All State football player for his high school and played football for the University of Texas. He served in the Pacific as a marine during World War II and afterward became a successful merchant in Texas City, Texas, the small town I grew up in. Although his sister Zidella became one of the first female graduates from the University of Texas Medical Branch, it was from my father that I learned some essential health tips that impact my life even today. As Father's Day approaches, it seems a good time to share them with you.

Exercise every day. Dad walked every day. He would round up people to go with him and walk down the Texas City Dike, a two-mile road that projected into Galveston Bay. Sometimes he walked along trails that the city provided,or if the weather was bad, he'd just walk though the house round and round until he got his exercise in. Before he walked he had a simple series of exercises to stretch his muscles -- touch your toes, holding arms out to the side and move them in tiny circles, sit ups. No equipment required. Just make the time, count the number you want to do and do it as part of every day for about 20-30 minutes for all of your life.

Eat to live, not live to eat. Dad ate basic, whole foods. Cream of wheat or oatmeal or a soft-boiled egg for breakfast with a glass of milk; a sandwich with lettuce and tomatoes or a bowl of soup for lunch; and baked chicken or fish or occasionally a steak along with a salad and a small dessert for dinner. No fancy and caloric sauces. No second portions.

Get enough sleep. Long before we knew that too little sleep led to an increase in diabetes, obesity and high blood pressure, Dad made sure to get his 7-8 hours in every night. He worked hard and knew that if he was rested, he felt better.

Wash Your Hands. If you look at the directions for hand washing from the CDC, you'll find that hand washing with soap and running water is one of the most important steps we can take to avoid illness. Afterward he would use the paper towel to turn off the handles of the faucets and to open the doors before throwing the toweling away -- just like the CDC recommends. He followed their other recommendations on hand washing as well. And he was doing this before the CDC was founded in 1942.

Don't Smoke. For several years Dad smoked one cigarette a day when he came home from work. It was a way he relaxed for a few minutes. In 1964 when the Attorney General announced that smoking was linked to cancer, Dad threw away his cigarettes and never picked up another one. As he put it, "If those things can cause cancer, why would I smoke them?"

Incorporate Spirituality and Socialization Into Every Day. In his book Thrive, Dan Buettner explores the world's happiest people and finds that among other things, the happiest people have a sense of spirituality and socialize up to seven hours daily. Dad read from his prayer book every day when he woke up and loved to spend afternoons and weekends with family and friends in the pursuit of simple pleasures -- going to the beach, fishing, going out to dinner with friends, and visiting people in hospitals and similar places and spending time just making them feel good. Buettner also points out that only about 10 percent of our longevity is determined by our genes; the other 90 percent is determined by our lifestyle.

Sing Whenever the Feeling Grabs You. My life was filled with music; Dad saw to that. He sang at just about every opportunity he had, including singing wedding songs in his store to couples he sold wedding rings to. He would sing in any building where the acoustics were good and belt out "Fly Me To The Moon" on escalators in large hotels as he ascended to the top. Many studies have shown that singing can lower blood pressure, boost the immune system, improve breathing, reduce perceived pain, promote learning in children, forgo comforting memories and reduces stress. Dad had a great impact on me and, as a result, on the thousands of patients I've treated over the years. He taught me how important it is to develop healthy habits that are part of every day. Incorporating these simple habits provides small differences that make a large impact on us over a lifetime. It's how we influence the 90 percent of our lives that is determined by lifestyle and allows us to live happier, healthier, more-vibrant lives.

Dad is no longer with us. I wrote this song for Father's Day in honor of him. I think many of you will relate to it. Enjoy!

CAIRO (AP) ? Egyptians are choosing between a conservative Islamist and Hosni Mubarak's ex-prime minister in a second day of a presidential runoff that has been overshadowed by the domination of the country's military.

Going head-to-head in the runoff are Ahmed Shafiq, a longtime friend and self-confessed admirer of Mubarak, and Mohammed Morsi of the fundamentalist Muslim Brotherhood.

The Saturday-Sunday vote followed a week of political drama in which the military announced de facto martial rule and judges appointed by Mubarak before his ouster dissolved the freely elected, Islamist-dominated parliament.

The generals who took over from Mubarak 16 months ago are expected this week to spell out the powers of the new president and appoint a 100-member panel to draft a new constitution.

Nokia hints at June 18th news, may be PureView related instead of Microsoft

Amidst the upheaval in Espoo Nokia continues to push forward, and tonight its Facebook page has already posted a couple of teaser images, including the one seen above, suggesting there's big news due on June 18th. Astute observers will note that's also the day its good buddy Microsoft has already planned its own high profile and highly secretive event, although you may not want to connect the two just yet. One of the images is a map of Hawaii, which AllThingsD notes is home to area code 808, a possible reference to Nokia's PureView 808 41MP cameraphone technology, which was followed up by the above image, with tempo cranked all the way up (ready to to go boom...like an 808?). Draw your own conclusions -- of course we'll be hanging around Monday to see what happens.

Update: If the Roland TR-808 image wasn't explicit enough, Nokia US has dropped another hint on its Facebook page, featuring what appears to be artwork cropped from the 808 State album ex:el.

92% Safety Not Guaranteed

Neatly, the script embarks on one journey while dangling the possibility of another: the prospect of taking a sudden leap from comic reality into the realm of pure imagination.

"Safety Not Guaranteed" is most vibrant and vital at its edges, in the way that the characters interact with each other while waiting for something to happen.

It's brisk and assured and never begs the audience's indulgence. No time is wasted. The movie is, at every moment, either funny or pushing the story forward, or both.

The film is modest but skillful and heartfelt, spiced just so by Plaza and company.

Safety Not Guaranteed casts an enchanting spell from its opening scene.

Expectedly funny but unexpectedly touching, too.

Have you ever wondered what mumblecore sci-fi would look like? Wonder no more.

Rather than trying to beat Hollywood at its own game of high-tech gadgets and weaponry, director Colin Trevorrow and writer Derek Connolly achieve a sly mix of the insane and the mundane.

A character-driven piece about regret and true partnership - our basic, primal need for someone to take the journey with us even if safety is not guaranteed.

Aubrey Plaza is the best thing about this iffy mock-sci-fi doohickey.

A strange, light-hearted bit of quasi-sci-fi, with no small amount of heart.

The material is played mostly for laughs and succeeds in that regard. The undercurrent of lament in Safety Not Guaranteed, though, is what holds the film together.

If safety isn't guaranteed by the film's title, a viewer's satisfaction with this genial, warm-hearted movie pretty much can be.

One central recasting and brutal editorial session away from being a lovely little short film, where its mystery and sentiment is more easily controlled and considered.

With its well-constructed screenplay, sharp dialogue and unapologetic sincerity, this first feature from former SNL interns Colin Trevorrow and Derek Connolly is its own act of nostalgia...

It should work for either fans of quirky romcoms or Aubrey Plaza.

A paper published this week in Scienceprovides the most nuanced view to date of the small, shifting human populations in much of the Amazon before the arrival of Europeans. The research, which includes the first landscape-scale sampling of central and western Amazonia, finds that early inhabitants were concentrated near rivers and lakes but actually had little long-term impact on the outlying forests, as if they merely tiptoed around the land far from natural sources of water. In doing so, the new study overturns the currently popular idea that the Amazon was a cultural parkland in pre-Columbian times.

The Amazon Basin is one of Earth's areas of highest biodiversity. Therefore, understanding how Amazonia was modified by humans in the past is important for conservation and understanding the ecological processes of tropical rainforests.

Researchers, at Florida Institute of Technology, the Smithsonian Institution, Wake Forest University and the University of Florida looked at how widespread human impacts were in Amazonia before the Europeans arrived. If the Pre-Columbian Amazon was a highly altered landscape, then most of the Amazon's current biodiversity could have come from human effects.

The research team, led by Florida Tech's Crystal McMichael and Mark Bush, retrieved 247 soil cores from 55 locations throughout the central and western Amazon, sampling sites that were likely disturbed by humans, like river banks and areas known from archeological evidence to have been occupied by people. They also collected cores farther away from rivers, where human impacts were unknown and used markers in the cores to track the histories of fire, vegetation and human alterations of the soil. The eastern Amazon has already been studied in detail.

McMichael, Bush, and their colleagues conclude that people in the central and western Amazon generally lived in small groups, with larger populations on some rivers.

"There is strong evidence of large settlements in eastern Amazonia, but our data point to different cultural adaptations in the central and western Amazon, which left vast areas with very little human imprint," said Bush.

They did not live in large settlements throughout the basin as was previously thought. Even sites of supposedly large settlements did not show evidence of high population densities and large-scale agriculture. All the signs point to smaller, mobile populations before Europeans arrived. The impacts of these small populations were largely limited to river banks.

"The amazing biodiversity of the Amazon is not a byproduct of past human disturbance," said McMichael. "We also can't assume that these forests will be resilient to disturbance, because many have never been disturbed, or have only been lightly disturbed in the past."

Certainly there is no parallel in western Amazonia for the scale of modern disturbance that accompanies industrial agriculture, road construction, and the synergies of those disturbances with climate change."

Police report: megachurch pastor choked daughter

ATLANTA (AP) ? The 15-year-old daughter of megachurch pastor Creflo Dollar told authorities her father choked and punched her, and hit her with his shoe during an argument over whether she could go to a party, according to a police report.

Dollar's 19-year-old daughter corroborated most of her sister's story, but Dollar disputed it, telling a sheriff's deputy he was trying to restrain her when she became disrespectful. When she began to hit back, he wrestled her to the floor and spanked her, according to the police report.

Dollar is one of the most prominent African-American preachers based around Atlanta. His World Changers Church International has 30,000 members in the Atlanta area, and the ministry has satellite churches across the U.S.

Dollar faces misdemeanor charges of simple battery and cruelty to children. He has been released from jail and his lawyer said he is expected to preach Sunday.

Dollar said in a statement Friday he loved his children and would never hurt them.

Around 1 a.m. Friday, his 15-year-old daughter called 911. She told a Fayette County sheriff's deputy that she and her father argued when he said she couldn't go to a party Saturday night, according to the report.

She went into the kitchen with her older sister. When her father asked why she was crying, she told him, "I do not want to talk right now," the report said.

Her father charged at her, put his hands around her throat, began to punch her and started hitting her with his shoe, she told the deputy. The deputy noted a scratch on her neck.

Dollar told the deputy he wouldn't let his daughter go to the party because of poor grades.

The deputy also interviewed Dollar's 19-year-old daughter, who said her father grabbed the younger girl's shoulders and slapped her in the face and choked her for about five seconds. She said her sister tried to break free, but did not fight back. When her father threw the 15-year-old on the floor, the older girl ran to get her mother.

The deputy also spoke to Dollar's wife, Taffi, who said she did not see the fight.

After interviewing Dollar and the two girls, the deputy asked for written statements. The older daughter initially wrote a statement that contradicted what she had told the deputy and was more in line with what Dollar said. When the deputy confronted her about the discrepancies, she told him it was because her parents were with her. Later, when separated from her parents, she wrote what she initially told him.

The 50-year-old Dollar leads the Creflo Dollar Ministries and is the pastor for World Changers Church International in the Atlanta suburb of College Park. World Changers Church-New York hosts over 6,000 worshippers each week.

Satellite churches are also in Los Angeles, Indianapolis, Washington, Cleveland, Dallas and Houston.

He and his wife, a co-pastor at the church, have five children, according to the church's website.

Dollar is a native of College Park and says he received a vision for World Changers Ministries Christian Center in 1986. He held the first service in front of eight people in an elementary school cafeteria.

His ministry grew quickly and the church moved into its present location, an 8,500-seat sanctuary, on Dec. 24, 1995.

Dollar said in a 2007 interview with The Associated Press that he renounced his church salary, and his income only comes from personal investments, including a real estate residential property business and horse breeding company called Dollar Ranch. He's also published more than 30 books, focusing mostly on family and life issues, including debt management.

He said he also sometimes got up to $100,000 for a single appearance on his packed schedule of speaking engagements.

Along with Bishop Eddie Long, Dollar is one of the most prominent African-American preachers based around Atlanta who have built successful ministries on the prosperity gospel, which teaches that God wants to bless the faithful with earthly riches. Ministers in this tradition often hold up their own wealth as evidence that the teaching works.

Long and Dollar were among six televangelists investigated by Iowa U.S. Sen. Chuck Grassley from 2007 to 2010, following questions about personal use of church-owned airplanes, luxury homes and credit cards by megachurch pastors and their families. The report did not find any definitive wrongdoing, but it expressed concern about the lack of financial oversight at such large ministries.
