Why 'singing' sand dunes hum certain notes

ScienceDaily (Oct. 24, 2012) ? What does Elvis Presley have in common with a sand dune? No, it's not that people sometimes spot both in the vicinity of Las Vegas. Instead, some sand dunes, like The King, can sing. And new research looking for clues to how streams of sand can sing may explain why some dunes croon in more than one pitch at the same time.

Sand dunes only sing in a few areas across the globe, and their songs -- always a low, droning sound -- have been an object of curiosity for centuries. Marco Polo encountered their haunting drone during his travels and Charles Darwin, in his book "The Voyage of the Beagle," wrote of testimonials from Chileans about the sound of a sandy hill they called the "bellower."

The song of the sands is a low hum at a frequency within the bottom half of a cello's musical range. These dunes only sing when the sand is sliding down their sides. People can set the sand in motion themselves or, more eerily, the wind can create sand avalanches, creating a sudden, booming chorus.

Scientists previously thought the sound arose because avalanching sand created vibrations in the more stable underlayers of the dunes. But evidence that the avalanche of sand itself sings, not the dunes, emerged from experiments in 2009 by researchers who got a shallow pile of sand to sing while spilling down a laboratory incline. Now, the same research team has investigated a deeper mystery of the dunes -- how multiple notes can sound simultaneously from one dune.

To study this question, physicist Simon Dagois-Bohy and his fellow researchers at Paris Diderot University in France recorded two different dunes: one near Tarfaya, a port town in southwestern Morocco, and one near Al-Askharah, a coastal town in southeastern Oman. No matter where recordings were made near the Moroccan dune, the sands sang consistently at about 105 hertz, in the neighborhood of G-sharp two octaves below middle C. The Omani sands also sang powerfully, but sometimes unleashed a cacophony of almost every possible frequency from 90 to 150 hertz, or about F-sharp to D, a range of nine notes.

The research will be published this Friday in the American Geophysical Union journal Geophysical Research Letters.

Even though the Omani dunes are somewhat sloppy singers, the researchers identified some tones that were slightly stronger than others. But with all the sand avalanching at once, those prominent frequencies were often buried in sea of notes. The scientists also observed that sand grains from the Omani dune came in a much wider range of sizes than their Moroccan counterparts. The Omani dune's grains were 150 to 310 microns, while the Moroccan dune's grains were only 150 to 170 microns.

So Dagois-Bohy and his colleagues brought grains from the Omani dune back to the lab. First, they ran the mix of the Omani sands down a constructed incline, recording its sound with microphones and measuring the sand's vibrations with sensors that floated on the surface. Then, they used a sieve to isolate the sand grains that were between 200 and 250 microns, and ran those sands down the same slope.

The researchers then compared the sound of the isolated sands with the sound of the mixed-size control. They found that while the grains of a broad size range sang noisily, the sands of a narrow size range sang a clear note at about 90 hertz, much like the Moroccan sands do naturally. This suggested that grain size is an important factor in what tone the dunes sing, Dagois-Bohy said.

"The sound we hear is correlated to the size of the grains," he said. "So we can start to say that the size of the grains is important."

The research team suggests the grain size affects the purity of tones generated by the dunes. When grain size varies, the streams of sand flow at varied speeds, producing a wider range of notes. When the grains of sand are all about the same size, the streams of sand within the avalanche move at more consistent speeds, causing the sound to narrow in on specific tones. But scientists still don't know how the erratic motion of flowing grains translates into sounds coherent enough to resemble musical notes, Dagois-Bohy said.

His team's hypothesis is that the vibrations of flowing sand grains synchronize, causing stretches of the sand grains to vibrate in unison. Their thousands of meager vibrations combine to push the air together, like the diaphragm of a loud speaker, Dagois-Bohy said. "But why do they synchronize with each other?" he noted. "That's still not resolved."

"The study attempts, and I think succeeds in many ways, to solve the problem of what's the mechanism" that translates tumbling sand into a song, said Tom Patitsas, a theoretical physicist at Laurentian University in Sudbury, Ontario, who did not participate in the study. Patitsas said the theory behind the sound still requires more elaboration to explain why, for example, the flowing sand still needs a thin layer of stationary sand underneath it to make a sound. He suggests the sliding sands resonate with similar-sized grains beneath the avalanche. Those buried grains may lie in chain-like patterns that intensify the resonance. "Once you have this resonance, the amplitude of the vibration will be large," Patitsas said.

Jon Stewart: 'I think Romney's leaning Obama'

By Craig Berman, NBC News contributor

Comedy Central

Jon Stewart takes a closer look at the final presidential debate on "The Daily Show."

Admit it. We?re happy the presidential debates are done, right? Even late night talk show hosts seem ready for the page to turn on the news cycle already.

Tuesday marked two weeks to go until Election Day, and in one of the milestones denoting the end of the process, it was also the last round of debate recaps on the ?Daily Show.? Host Jon Stewart was less ranty than he had been after the first two. Instead, he was fascinated by the amount of support Mitt Romney had for President Barack Obama?s foreign policy approach.

After months of the Republican candidates and his party?s blistering attacks on Obama?s decisions, there was a surprising amount of agreement on issues like drones, Afghanistan, and even Iran.

?I think Romney?s leaning Obama,? Stewart said after showing a round of clips where Romney praised the current administration?s policies. ?Apparently Romney?s one of those coveted swing voters.?

Among the issues of agreement: Romney?s desire to dissuade Iran from having a nuclear weapon through peaceful and democratic means. ?Get a haircut, hippie,? Stewart said.

What Romney is offering that he claims is lacking in the current administration is leadership. But with the similarities between the two?s policies, it?s hard for Stewart to see how that would happen.

?Follow me!? Stewart said, in a possible Romney leadership speech. ?I?ll be right behind the president!?

Stephen Colbert watched the debate as well, and noticed the fixation that everyone had with Israel.

?I was playing a drinking game last night where I took a shot of Manischevitz every time someone said Israel, and by the end of the debate I was totally ? diabetic,? Colbert said. Which, given the sweet character of the wine, would not be a surprise.

More than Stewart, Colbert noticed some differences between the candidates. For example, Romney criticized Obama for his Iran policies by noting that Iran is now four years closer to developing a nuclear bomb. Of course, given that time only moves in one direction, so is everyone else -- including Colbert himself.

?Admittedly, I?m still far away ? at the Mentos and diet coke stage,? Colbert said. ?But still.?

With the election tightening and a tie now a possibility, Colbert?s also looking forward to the return of his old friend. ?As we know from history, the rules clearly dictate that in the event of a tie, our next president will be George W. Bush,? he said.

If the Democrats were looking for a Get Out the Vote strategy, that would do it.

But over on "Late Night With Jimmy Fallon," the pre-Election Day tension eased.?

The candidates (or at least reasonable facsimiles) put the debates and disagreements behind them in favor of a "hang session."

What Obama and Romney will say, and what?s the truth

Monday's debate at Lynn University in Boca Raton, Fla.?the last of the presidential race?will focus on foreign policy. What to expect from President Barack Obama and Republican presidential nominee Mitt Romney, who are neck-at-neck in recent polls? Some bluster on China, hedging on Libya, and possibly, silence on Syria. Naturally, expect some campaign spin, too.

To clear the candidates' smoke around foreign affairs, we've collected and fact-checked the key foreign policy points to keep in mind during the debate, from trade to terror.

Libya

Romney: The president's greatest vulnerability on foreign policy is possibly the controversy surrounding the terrorist attack that killed U.S. Ambassador Chris Stevens and his team in Benghazi, Libya on September 11 of this year. The attack remains subject of an ongoing investigation, so any discussion suffers for a lack of the complete, official account of what happened that day.

In the last debate, when answering a question about Benghazi, the candidates spent almost the entire time discussing the semantics of phrases like "act of terror" rather than scrutinizing the actual attack. Romney accused the president of refusing to call the murders a terrorist attack until 12 days after the incident.

Romney will probably avoid fussing over vocabulary this time around. At the Town Hall-style debate last Tuesday he was fact-checked in real time by moderator Candy Crowley. As she noted, 18 hours after the event, President Obama said this in the Rose Garden:

No acts of terror will ever shake the resolve of this great nation, alter that character, or eclipse the light of the values that we stand for.? Today we mourn four more Americans who represent the very best of the United States of America.? We will not waver in our commitment to see that justice is done for this terrible act.? And make no mistake, justice will be done.

As for the statements of Ambassador Susan Rice?whom Romney and Republicans claim diverted from the "terrorism" message, calling the murders spontaneous on Sep. 16?it's been known for some time that she and other officials were given talking points by the CIA, which ended up muddying the administration's position on the nature of the attack.

There are many other aspects of the president's handling of the attack that Romney may criticize?but if he returns to the "terror" talk, Obama is likely to have the transcript ready.

Obama: At the same time, the president is not being fully straightforward about why the Benghazi issue has become such a hot topic.

What is clear so far?from testimony given to a House investigation of the attack?is that the State Department denied requests for increased security personnel from its regional security officer for Libya; this included the city of Benghazi, where Stevens and his team were stationed.

President Obama will likely continue to avoid any direct comment on the potential negligence of the State Department in this matter, especially since Secretary of State Hillary Clinton has gone on record exculpating the president of any of the decision-making that took place leading up to the attack.

Afghanistan

Romney: Both candidates have heard the American people loud and clear: most people have totally soured on the continuing war effort in Afghanistan. The fact that only 27 percent of the public believes in the campaign has now motivated a usually hawkish Mitt Romney to lend his support to the president's 2014 withdrawal plan.

In a recent interview to ABC, GOP vice presidential nominee Paul Ryan claimed that his running mate has ?"always agreed" with the timetable. Politifact uncovered several instances in which Romney did indeed voice support for that deadline?but usually with the hyper-qualifying addition that he would have to judge the "situation on the ground."

This could be the difference between withdrawal in 2014 and a renewed commitment to infrastructure, counterinsurgency, and military training in Afghanistan for several more years. As Josh Rogin notes in Foreign Policy magazine, even notable Republicans are aware of the elasticity of Romney's declared Afghanistan policy; and so while it is not a claim in direct conflict with the truth, his insistence that he has a clearly defined broad strategy for America's longest and now very unpopular war does not ring true with many both in and out of his party.

Iran

Romney: Romney is known to downplay the observable effects of the Obama administration's sanctions on Iran. He repeats variations on the line that he delivered earlier this year: that Obama "could have gotten crippling sanctions against Iran," but did not.

Given that Obama has presided over biting sanctions on the Islamic Republic?sanctions that Iran's leaders identify as responsible for the battering of its currency and wider economic turmoil?this talking point requires clarification. When asked about it, Romney's campaign told PolitiFact that the GOP candidate was specifically referring to an instance in 2010 when the administration failed to pass a U.N. resolution sanctioning the Iranian Central Bank.

Setting aside the probability that the veto-prone U.N. giants Russia and China would've blocked that particular resolution if it were pushed by any U.S. administration, it looks as though Romney is hoping this maneuver will come off to undecided voters as a broader failing of Obama's Iran policy

Obama: The Obama campaign has pushed back on this Romney line, stating that the president is waging an unprecedented diplomatic and economic effort to squelch the ayatollah's nuclear program. But the administration overreaches when it makes statements giving the impression that before Obama's presidency "there was no international pressure on Iran," to quote VP Biden.

PolitiFact.com notes a few serious international initiatives the Bush administration undertook to stifle the Iranians' nuclear program:

  • Resolution 1737, passed in 2006, which banned trade with Iran in all items, materials, equipment, goods and technology that could contribute to the country's development of nuclear-weapon delivery systems.
  • Resolution 1747, adopted in 2007, which banned the country's arms exports and restricted the travel of additional individuals engaged in Iran's nuclear activities.
  • Resolution 1803, approved in 2008, which froze the assets of people involved in the nuclear program.

Despite the current campaign of sanctions, the theocratic regime has not renounced its nuclear ambitions. However, rumblings this past weekend of possible one-on-one negotiations has analysts wondering if there may finally be ground for a diplomatic solution.

So while Romney will likely try to undermine the severity of the administration's sanctions, expect Obama to leave out the fact that, not only do sanctions predate his taking office, but they still haven't achieved their main purpose.

China

Obama: The tall tales over "sticking it to China" continue: in the last debate, Obama turned to his opponent and said, "you're the last person who's gonna get tough on China."

This came after the usual attacks on Romney for investing in Chinese firms; the president often alleges that Romney is a "job exporter" and usually exaggerates the personal involvement the GOP nominee has had in his investments abroad. Super PACs supportive of the president echo this line of attack, broadcasting that thousands of Chinese employees "owe their jobs" to Romney.

While it's true that a good deal of Romney's money is invested in China, Obama's charges that Bain-affiliated companies shunned America while running straight for Asia are mostly misleading: a larger trend in the global market determined their production would be located in China.

What's more, Obama tends to conflate the fact that many Chinese employees found jobs at companies that Romney had invested in with the more controversial idea that Romney "outsourced" American jobs as a matter of protocol.

Romney: Last time around, Romney repeated his charge that the president allows China to cheat trade agreements through currency manipulation, declaring that Obama has had "seven opportunities to stop them" by slapping the "manipulator" label on Beijing via the Treasury. Romney says he wouldn't hesitate to use the label, which would pave the way for settling the issue via the International Monetary Fund.

It's true that the Obama administration has passed labeling China a "manipulator," but what makes this charge hyperbolic is that it's never been clear that doing so would stop it from cheating. As PolitiFact notes, it was tried in 1994 to no avail. Plus, the idea that the Obama administration has simply been appeasing China amid its economic mischief is false: Sticking with Romney's magic number, the administration has filed seven trade complaints against China through the WTO.

Feng Shui: Tokyo Film Festival Review - The Hollywood Reporter

The Bottom Line

A commanding performance from Yang Bingyan anchors director Wang Jing?s grim assessment of modern city life in mainland China.

Director

Wang Jing

Cast

Yan Bingyan, Jiao Gang, Chen Gang

The yoke of poverty proves an enduring burden in Feng Shui, Chinese director Wang Jing?s compassionate study of a working-class woman?s struggle to improve her status during the sharp economic rise of the 1990s. Stepping outside his social-issues wheelhouse with this piercing family drama, the director reveals a keen eye for high-stakes interpersonal conflict and the inner torment roiling within ordinary people.

Older audiences will appreciate the measured, conventional storytelling, elevated by a stunning central performance from veteran Beijing-born actress Yang Bingyan, who is rarely off-screen and convincingly roams the emotional gamut. Her devastating portrayal of a woman undone by a preoccupation with success makes this Mandarin-language production a solid booking for further Asia-centric festivals following its premiere in competition at the Tokyo International Film Festival.

With 2009?s Invisible Killer, a murder mystery highlighting the destructive power of the internet, and 2010?s Vegetate, which took a critical look at China?s pharmaceutical industry, Wang Jing has built a reputation for taking on pressing social issues. Condemnation of the wrenching social transformations which accompanied the country?s rapid economic growth is common among Chinese auteurs, but here it is used to background a drama that is resolutely individual in its focus.

Li Baoli (Yang) works as a shopkeeper?s helper in the heavily populated central Chinese city of Wuhan. She?s a tortured soul, racked by anguish and indeterminate rage, which manifests itself in torrents of abuse and scorn heaped upon her husband and her studious young son. In short, she?s a shrew.

She continues to berate her milquetoast husband Ma Xuewu (Jiao Gang) even as his steady job as a factory team leader provides them with the means to move into a well-appointed highrise apartment where, she is momentarily pleased to discover, they have the luxury of their own bathroom.

Wu Nan?s screenplay, based on a novel by Fang Fang, keeps Baoli?s inner dialogue from us so we are sometimes at as much of a loss to fathom her emotional thrashing about as her family and friends are. Making this protagonist sympathetic is a Herculean task, but Yang (Memory of Love, Close to Me) rises to the challenge, giving us glimpses of the panic behind her agitation and the steely determination she musters just to carry on.

Yang, de-glammed but still beautiful, carries her former dancer?s body clenched like a fist, her gait awkward with compressed fury. Jiao?s (Mao?s Last Dancer) considerable height seems diminished before her ? his bespectacled lightweight is not so much hen-pecked as clobbered into submission. He?s not a bad husband or father, he?s just not enough of anything for Baoli.

When Baoli?s unremitting spite drives Ma Xuewu into the arms of another woman ? and further, to a tragic end ? she barely falters, shouldering the breadwinning load in a way-too-literal metaphor as a yoke-bearer in the marketplace. ?The Yin flourishes when the Yang fails,? quips a friend and confidante, in one of many allusions to the current of gender politics coursing through the film. ?

Working to support her son and elderly mother-in-law, the hardscrabble existence and sense of purpose seem to agree with her. But still she?s earned no peace and struggles to make sense of the shambles her life has become, particularly when an ugly tussle with Jian Jian (Chen Gang), a streetwise acquaintance turned casual lover, jeopardizes her son?s all-important final exams.

Dimly lit interiors and overcast skies contribute to the downbeat mood, bleak as Liu Younian?s slate-grey cinematography. The film?s title refers to a superstitious friend?s explanation for Baoli?s woes. The new family home is located smack-bang on an intersection where seven roads converge: bad Feng Shui.

As his camera moves low through congested city streets teeming with battling humanity, Wang suggests something more pragmatic: for some unlucky souls life?s just full of pain.

The branding behaviours of high growth businesses | Nurture Network

The most powerful brands mean something to people; they have values and are emotionally attractive to their target audience. Whether you look at a social-tech start-up like Instagram, which sold to Facebook for $1bn aged just 18 months old, or at UK consumer brands like Ella?s Kitchen, which at 6 years old now has 14% share of the UK baby food market and a turnover of ?60m, the learnings are the same: They set out to create a new market or completely disrupt an old one. To do this you need to have a very clear idea of who you are and what you are doing, and this, whether you are B2C or B2B, is about branding.

Branding is often misconstrued to be the visual elements that represent your business, but to create effective brands, the real work starts long before the creative people are let loose with their colouring pencils. It is fundamental that the business team works together to answer some core questions first. So here are the five critical principles which we focus on at The Nurture Network to create stand-out brands from day one.

Who are you? What do you stand for?

Your brand positioning is the essence of what you are about, and what you want others to see you as. It should concisely sum up your brand ? without fussy words, lengthy sentences, or explanatory sub headings, with language that emulates the impression you are trying to create. Crack this and your positioning builds to be emotive and more than the sum of its parts ? effecting the whole of your business.

Paul Lindley, founder of Ella?s Kitchen, developed a brand positioning that effortlessly sums up their mission to revolutionise kids? eating habits by making healthy food tasty and fun. This compelling positioning can be seen in their tactile packaging, the naming of their products as ?The Red One? and ?The Yellow One? and in the innovation that they develop.

Mean something to someone but not everyone

Never fall into the trap of trying to be liked by everyone. Head down this road (and many do) and you?ll be vanilla and not meaning anything to anybody.

Successful brands focus their energy on a distinct target audience looking to create a passionate bond with them, even though they may be hated by others. One of the most publicly extreme examples is from Mike Jefferies, CEO of Abercrombie and Fitch who famously said ?We hire good-looking people in our stores? Good-looking people attract other good-looking people, and we want to market to cool, good-looking people.?

Controversial as it is, they have marketing to generation-Y absolutely nailed ? they understand them and focus on them only. The opposite of love is not hate ? it is complacency ? and complacent customers are not loyal. So decide who your ?someone? is ? define them as one person and make, do and say everything with them in mind.

Define how you act

Whether you prefer to think of it as brand values, beliefs or business ways of working, capturing the way you want to act is vital to creating a scalable business. Left undefined, the way the founders or management team do things gets lost through the business and the customer experience becomes lacklustre.

How you act covers two areas ? how you talk to consumers, and how you want everyone to act within your company: Moo.com revolutionised the B2B stationary printing market with a simple online platform brought to life with a friendly brand tone-of-voice which talks customers through the process.

Defining how you want people in your business to act often comes down to ethics or values, but some businesses ? such as Innocent ? develop one central ?way? running across the team and to customers. They have job titles like chief mixer (for the product technologist), chief writer (for copy writer) which brings the personality we all recognise from their smoothie bottles within the office environment too.

Understand your visual codes

For every brand behemoth like Coca-Cola, there are thousands of newer brands trying to standing out and attract the attention of potential customers.

Your codes are those elements of your brand that customers associate with your product or service such as logo ? but it doesn?t stop there. Your colour scheme, fonts, imagery and tone make up the brand codes that signal to customers it is you. Create strong enough visual codes and your customers will know it is you even when you play with your codes ? like Google does with their daily doodles. This is how you can know the brand in a TV advert even before they expose the logo or product.

If you have a story, use it

Most entrepreneurial brands have one consistent thing ? a powerful start-up story ? and it can add depth and integrity to a brand for customers.

At Ella?s Kitchen, Paul Lindley?s job title is simply Ella?s Dad because he started the business to solve the problem of his daughter?s dislike of healthy foods. At bespoke tailoring company A Suit That Fits, the wonderful story of co-founder Warren teaching in Nepal underpins the ethical manufacture that continues to this day ? and customers relate to the brand more because of this.

Branding is a complex and emotionally led business, but has tremendous power in its ability to connect with customers and drive that all-important thing called ?loyalty? that every high-growth business wants. If you want to address your branding take a look at our workshops ? you could even do this with the benefit of support from GrowthAccelerator. Find out more email workshops@thenurturenetwork.co.uk

Helpful Points About Mobile Sports Betting - Arts & Entertainment ...

With regards to putting bets plus monitoring the chances for their preferred sports gamble, mobile sports betting has provided individuals much more flexibility. From football to horse racing, enthusiasts have already been gambling around the outcome of a number of sports for hundreds of years. Nowadays, with online bookmakers as well as casinos ? plus a variety of mobile apps created for each and every ? it is easy for both brand new and also experienced bettors to keep up with the action anytime, from anywhere.

Mobile Betting On Sports

Many people are by now knowledgeable about online sports betting. Sports books are offered around the globe and offer a chance to place wagers on a variety of sports, including basketball, soccer, cricket, and much more. Websites like these enable people to browse the accessible wagers and review their odds, as well as deposit funds and put bets on their own predicted outcome. When someone places a fantastic bet, the sportsbook deposits the profit into the player?s account. A percentage from the earnings is often subtracted as a commission to the bookmaker.

Betting on the Move

To meet the demands as well as expectations of the online gambling area, many casinos and bookies provide applications for mobile devices to ensure that customers can continue to access their own accounts whenever they?re away from a pc. Mobile casino and gambling apps are downloaded on the user?s cell phone or other backed mobile device. With the app installed, individuals can savor the top features of their most favorite betting website with all the added ease of availability on the go.

Starting Out?

Mobile sports betting is quite similar to placing bets through an online bookmaker. Those who already have a bank account with a reliable sportsbook may usually just set up the application and sign into their account with the same password and username that they use online. Those people who are a new comer to sports betting only have to setup an account to get started. This can be achieved via the mobile phone with lots of applications, but it?s often easier for the gamer to set up their own account from their home computer. In either case, it takes only seconds to join the action.

Creating Deposits

Aside from setting up an account with an online sportsbook or casino, people will also need to fund their own accounts just before putting any wagers. Several mobile applications allow gamers to create deposits using their own mobile phones or maybe pc tablets, but again, it is usually simpler to perform this from a desktop computer. Once the account has the minimum funds needed by the casino, a person can use his or her mobile phone to examine the current chances, put wagers, monitor the results, and also hopefully win big.

The Very Best Mobile Betting Sites

Not all online bookmakers offer applications for mobile betting, however there are tons that do, and a number of casinos offering sports betting and access to a variety of games for an exciting mobile gambling experience. Depending on the nation that the gambling web site is certified through, there might be restrictions on who could set up an account and also the currency used. Make sure to browse the terms and conditions before selecting a mobile bookmaker. Also keep an eye out for bonus deals that sportsbooks might provide to mobile sports players. Developments in technology keep gambling even more thrilling and handy for that gamers who love it. Mobile betting plus casino apps are obvious proof.

Dizzying twists in immigration laws

Thanks to

Given the white-hot politics of immigration, it?s perhaps not surprising that President Obama instantly drew fire with a proposal in January to help undocumented spouses of American citizens obtain legal status ? without being ousted from the U.S. for years as punishment.

Rep. Lamar Smith, R-Texas ? the chairman of the House of Representatives Judiciary Committee ? accused Obama of ?bending long established rules? and pursuing a ?backdoor amnesty.?

?Who is the President batting for ? illegal immigrants or the American people?? Smith said in a statement.

Smith is no casual observer. He is the key author of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, which established penalties mandating years of exile for illegal immigrants before they can return to the United States and legalize ? even if they are married to an American citizen. Marriage is one of the primary ways a person obtains legal status within the largely family-based U.S. immigration system.

Republican members of Congress argued back then that more had to be done to discourage illegal immigration. Too many immigrants were entering the country unlawfully or overstaying visitor visas, members said, and were marrying U.S. citizens or legal residents and staying. Too many relatives of legal residents who were supposed to wait back home for visas, sometimes for many years, were entering ahead of time, illegally, and staying, members added. ?? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ? ??

Since the 1950s, some illegal immigrants, based on a job or other ties, had been able to plead for legal residency before immigration officials in the U.S. who had the power to grant them that status. In 1994, Congress adopted a statute that codified the ability of illegal immigrants with legitimate family sponsorship to transition to legal status without having to leave the U.S. They could complete their process by paying fees or fines, so long as they had no serious criminal record.

In 1996, Congress upped the fine from $650 to $1,000, and passed the 1996 legislation in an effort to toughen the procedures. Members wanted U.S. consular officers in the immigrants? homeland to screen applicants ? and then mete out years-long ?bars? to applicants who had tried to enter the U.S. illegally.

Ultimately, Congress allowed people who had filed petitions for legal status before April 30, 2001, to continue to seek legal status from within the U.S. Then it closed that avenue for immigrants if they originally entered the U.S. illegally ? which meant the 1996 legislation started to be more strictly enforced, even for those married to American citizens. ??

Here?s how the 1996 bars work:

If illegal immigrants entered the U.S. unlawfully, they must return to their home countries for a residency-application interview with U.S. consular officers, who then must apply bars if merited.

The two most basic penalties are three-year bars from the U.S. to penalize ?unlawful presence? in the U.S. for more than six months, and 10-year bars for unlawful presence in the U.S. of more than one year. Congress included a waiver possibility to shorten the bar for unlawful presence for some.

But decisions on waivers have taken months, even years, to complete. Waivers must be based on proof that the applicant?s American sponsor is suffering extreme hardship ? like a serious medical condition ? rather than just heartache or financial loss.

If immigrants have a history of two or more illegal entries to the United States, they aren?t even eligible to apply for hardship waivers. Their penalty is a lifetime bar, with a possible pardon if they remain outside the U.S. for 10 years, some have been told. If applicants are accused of having falsely claimed to be a U.S. citizen to enter the U.S. or of lying to a U.S. official, they can get a permanent lifetime bar.

Wayne Cornelius, an immigration expert at the University of California at San Diego, called the bars ?symbolic,? and said there?s no evidence they?ve played a serious role in reducing illegal immigration. After the bars were adopted, the estimated undocumented population in the U.S. rose from 8 million in 2000 to a peak of 12 million in 2007.

Jessica Vaughan, policy studies director at the Center for Immigration Studies, a Washington, D.C., group favoring less immigration, calls the bars ?proportionate to the offense.? But she also doubts they?ve had broad deterrent power.

?It is most definitely time to take a good, hard look at this section of the law,? Vaughan said.

Doris Meissner, who was Immigration and Naturalization Service commissioner in 1996, said the impact of mandatory bars on American families is ?crying out for broader discussion.? Meissner is now a fellow at the Migration Policy Institute, a nonpartisan research group in Washington, D.C.

On Jan. 6 of this year, U.S. immigration officials announced President Obama?s proposal to implement regulatory changes that address some of these complaints.

The changes, officials said, would benefit the immigrant spouses and adult children only of U.S. citizens ? and only if these undocumented relatives are eligible to apply for hardship waivers to overcome the bar for unlawful presence in the U.S. for more than one year.

?The proposal will not change existing laws,? Alejandro Mayorkas, director of U.S. Citizenship and Immigration Services, insisted in a press call. ?The [proposed] process would allow these individuals to have their waiver applications processed in the United States ? and receive a provisional waiver determination before they complete the visa process at a consulate outside the United States.?

The benefit wouldn?t be open to those whose previous offenses make them ineligible to apply for a waiver right away ? like those who had crossed the border illegally more than once. Couples filing hardship waivers risk failing, but officials said they expect many to succeed and avoid long separation.

Mayorkas said the administration was mindful, too, that families can face ?precarious? conditions when they travel abroad.

In 2011, U.S. citizen Jake Reyes-Neal, 21, was killed by thieves in an attack in Juarez, Mexico, where the Colorado man had moved with his undocumented wife and their baby to pursue a waiver at the U.S. consulate there.

Rep. Smith declined to comment on the concerns of citizens who face long separation.

His staff pointed to his statement in January, when he said waivers were ?not intended to be applied to millions of illegal immigrants.?

Other immigration hawks in Congress also declined comment, including Rep. Steve King, R-Iowa, and California Republican Reps. Dana Rohrabacher, Brian Bilbray and Elton Gallegly.

A notice of intent to adopt the new Obama rule was published Jan. 9 in the Federal Register. And the proposed rule was posted to the Federal Register April 2. A comment period ran from April 2 to June 1.

The final rule hasn?t been published yet, and immigration officials say they have no target date. When the rule is finally published, it will go into effect 30 to 60 days later.

If Obama isn?t president when it goes into effect, a new president ? Mitt Romney ? could undo the rule through the same rulemaking process.

Fidel Castro Stroke Reported: Physician Claims Former Cuba Leader 'Very Close To A Neurovegetative State'

Fidel Castro has suffered a serious, "embolic" stroke, according to a Venezuelan physician cited by The Miami Herald.

Jose Marquina, who spoke with El Nuevo Herald and claims "firsthand sources and information" about Castro's health, described the former leader's condition as "very close to a neurovegetative state." Castro is reportedly incapacitated, and "has trouble feeding, speaking and recognizing faces," Marquina said.

Rumors about the former dictator's supposedly failing health have surged in recent weeks. On Oct. 11, Venezuelan journalist Nelson Bocaranda said his death was imminent. Cuban state media released a statement on Wednesday that was purportedly written by Castro.

According to The Miami Herald:

Castro is in his home in El Laguito, Havana, receiving constant and specialized medical care, Marquina said. The idea of the Cuban authorities and Castro?s family is to maintain him alive and far from public view, the doctor said.

'He could last weeks like that, but what I can say is that we?ll never again see him in public,' said Marquina in a telephone interview from Naples.

The one-time revolutionary's last public appearance was in March, when he had an audience with Pope Benedict XVI.

AUTOS: All-New Corvette To Debut

Corvette fans should make a note on their calendar ? the redesigned 2014 Chevrolet Corvette will debut Jan. 13, the eve of press-preview days for the Detroit auto show.

To generate interest in advance of the new Corvette's debut, Chevrolet on Thursday released an image of the sports car's redesigned Crossed Flags emblem. The new emblem is ?much more modern, more technical and more detailed than before, underscoring the comprehensive redesign of the entire car,? General Motors design chief Ed Welburn said in a statement.

The first emblem that came with the original 1953 Corvette. (Photo: Chevrolet) Also on Thursday, Chevrolet dealers were told that Corvette production will stop for six months beginning in February, while the assembly plant in Bowling Green, Ky., is retooled to build the new car. Production of the 2014 Corvette will start in August or September.

Production of the 2013 Corvette, the last of the sixth-generation of the sports car, is set to end in February. Last year, GM said it would spend $131 million to upgrade the plant.

The redesigned 2014 Corvette is expected to be slightly shorter and significantly lighter than the current car, with an upgraded, more-comfortable interior.

Corvette chief engineer Tadge Juechter notes that only two parts are being carried over from the 2013 Corvette to the new car: the cabin air filter and the rear latch for the removable roof panel.

?With the new Corvette, we set out to build a world-challenging sports car with design, refinement, efficiency and driver engagement that is second to none,? Juechter said in a statement.

A key component of the new Corvette, known as the C7 for the seventh-generation car, is a new engine that will mark the fifth generation of General Motors' small-block V8. The new engine was designed for the Corvette and also will be used in GM's redesigned full-size pickups and SUVs, which also will debut at the Detroit auto show.

Details on the new small block V8 are set to be released on Oct. 24.

Thursday's release of the Corvette's new Crossed Flags emblem is the start of a multimedia campaign by Chevrolet leading up to the new sports car's debut:

? Chevy has launched a dedicated Web site, www.one13thirteen.com, where it will release a series of details about the car.

? It has a Facebook page, www.facebook.com/corvette.

? There is also a stream on the Twitter message service, @Chevrolet, with the hashtag #corvette. Chevy says people who follow the hashtag #one13thirteen will see exclusive updates.

Rover digs up shiny particles on Mars

NASA's Mars rover Curiosity has found some more bright stuff on the Red Planet, scientists say.

The Curiosity rover had dumped out a recent sample of Mars dirt after spotting shiny particles inside the hole dug by the shovel-like scoop on its robotic arm. Mission scientists were concerned that the bright material might be debris from the rover itself, so they ordered Curiosity to toss the Mars sample as a safety precaution, mission managers said in a statement.

As it turns out, the bright particles are actual Martian in origin, they added.

Curiosity is scooping up Mars dirt in a spot called "Rocknest" in preparation to deliver the first samples to a pair of instruments on its car-size body. The rover scooped its first Mars sample on Oct. 7, but further work was delayed when the rover's cameras spotted a bright object ? likely a piece of plastic ?on the ground in the area.

Scientists had cleared Curiosity to start scooping Mars dirt again ahead of the first sample study when they spotted the new bright material. Curiosity's initial Mars dirt scoops are designed to clean the rover's sampling system. [ Mars Rover Curiosity's Latest Amazing Photos ]

"Other small pieces of bright material in the Rocknest area have been assessed as debris from the spacecraft," NASA officials said in a statement Oct. 15. "The science team did not want to put spacecraft material into the rover's sample-processing mechanisms."

A new review of the latest bright material suggested it is actually a Mars phenomenon, and not litter from Curiosity. With that analysis in hand, rover scientists cleared Curiosity to take a third scoopful of Mars dirt.

"Confidence for going ahead with the third scooping was based on new assessment that other bright particles in the area are native Martian material," NASA officials said. "One factor in that consideration is seeing some bright particles embedded in clods of Martian soil."

Curiosity's third scoop of Mars dirt will be the first sample to actually be processed by the rover's Chemistry and Mineralogy instrument, known as CheMin. A later Mars sample will be scooped up and deposited inside the rover's Sample Analysis at Mars, or SAM, instrument.

The CheMin and SAM tools are two of the core instruments on Curiosity designed to determine if Mars may have once been habitable for microbial life.

The $2.5 billion Mars rover Curiosity has been exploring the Red Planet since Aug. 5, when it landed inside the planet's vast Gale Crater. Currently, the rover is driving toward its first major science target, a spot called "Glenelg" that offers a glimpse at interesting Martian terrain, scientists said.

The rover is about the size of a Mini Cooper car, making it the largest rover ever sent to another world. Curiosity is expected to spend at least two Earth years exploring the Red Planet.?

Remodeling Show :: 10 Products You Should Know (1):: Building ...

Remodeling Show Floor Entrance
One thing I was pretty stoked about with this year?s Remodeling Show was my Press pass. My first ever, and yes, exhibitors do seem just a bit more accommodating.? And while my experience was likely a little different (from last year?s Show), I still wanted to drop-in just the same. Rest assured I have at least a few more posts coming, but I wanted to start with a set of ?un-sponsored? product posts. And here you go ? 10 Products (or Developments) You Should Know? About.

*******

AZEK VAST being laid on grid* AZEK VAST Pavers (http://www.azek.com/vast/) ? Our very first stop of the Show, spurred possibly by an earlier encounter ? AZEK VAST is a lightweight paver that I first saw on the Homeowner and Trades Resource Center ? Sean Lintow?s impeccable website.? Pavers for Patios Decks & Roofs. ?Recycled mostly from rubber (tires), AZEK offers three types: Landscape, Resurface and Permeable, in 5 colors.? The Landscape pavers (a thicker profile) are designed for new construction patios and driveways. A Permeable counterpart, with spacer lugs, allow water infiltration in areas that are prone to storm water runoff.? Resurface pavers (a thinner profile) can be laid in a corresponding grid over existing decks, balconies ? old slabs and even on roofs.

* AllMet Stone-Coated Steel Roofing Systems (http://allmet.com/) ? As it seems I?ve talked a little recently about metal roofing, I couldn?t pass on the opportunity include AllMet here.? Offering all the benefits of metal roofing, include superior solar reflection and fire resistance, but with the look of more tradition granular?asphalt roofs ? these steel panels are very lightweight but still incredibly strong.? AllMet offers 20+ color, whichAndersen Home Style Book :: Andersen Booth at the Remodeling Show appear in shake-, clay tile- and traditional shingle- like styles.? The best part perhaps ? a lifetime warranty.

* Andersen Window & Doors (http://www.andersenwindows.com/) ? Andersen?s A-Series, constructed of the company?s Fibrex material and fiberglas, as well as the E-Series (formally Eagle and featuring aluminum cladding on a wood frame) were proudly on display in Andersen?s booth. The construction of these windows (not that they aren?t impressive) wasn?t however what caught our eye.? It was instead how Andersen is choosing to ? present them.? Perhaps a throwback to the pattern books of centuries passed, Andersen launched the Home Style Library earlier this year.? The Show marked the release of the first in a series of ?Home Style Pattern Books? where doors and (different) window types are grouped around traditional American architectural styles.? The ?Home Style Library? offers 10 different home styles ? from Craftsman Bungalow to Modern, from Georgian/Federal to Ranch.? Products are broken out for each style into ?recommended? sizes (with patterns & groupings), color, grilles, glass type and hardware.? Further, I learned that we can expect exploded details (both in print and online) on each style.? At the Remodeling Show, the Home Style Pattern Books for the Georgian/Federal and the Craftsman Bungalow were introduced. To see more: http://www.andersenwindows.com/A-Series/style-library/index.html.

* Versi-Foam (http://www.rhhfoamsystems.com/) ? Really, I am not going in alphabetical order, and to prove it ? (DIY) Spray foam insulation (and according to Sean Lintow, something I desperately need around the rim of my own house. Ha!)? Versi-Foam?s low pressure sKerdi Board demo Schulter Systems Booth at the Remodeling Showpray foam kits are available both in open cell and closed cell (though for most critical installations, we?d recommend closed cell).? They are portable and disposable ? no outside source of power or pressure is needed.? The totes that the company had on display didn?t look dissimilar to a large box of wine.? I mean ? Something you might see with low voltage cabling.? Each box includes two (chemical) components, plus a 10ft gun/hose assembly. While several options are available, a ?Standard? System 15 kit yields 200sf and a System 50 kit yields 600, both with an R-Value of 7.7 per inch.

* Schulter Systems (http://www.schluter.com/) ? Consistently one of the most heavily trafficked booths at the Remodeling Show ? Schulter Systems.? (And, yes, I?d say partially because of the giant orange demonstration clinic that sits immediately next to it ? hard to miss.)? I of course knew Schulter previously for their Ditra underlayment product, but this year I did make it a point to stop in, to find out ? what else?? ?System? is a fair word for Schulter with solutions running the gamut.? The Kerdi-Line drain, especially the ?concealed? version, is worth a look.? Kerdi-Board too seems like a solid option for building, well ? anything in the bathroom.? An extruded polystyrene foam and available in thicknesses ranging from 3/16? all the way up to 2?, it can be screwed right to studs, used as a backer or even, as shown , can be used as the structural framework for benches, tub1005 Design Aluminum BackSplash Booth at the Remodeling Show decks, countertops, etc. ?To find out more:? http://www.kerdi-board.com/.

* 1005 Design (http://1005design.com/) ? American Trim launched a line of decorative metal backsplashes.? Made of 30 gauge aluminum, these were certainly an eye grabber. ?Sold as kit and currently only on Amazon, they appear in 6 styles and in two finishes (a stainless look and a copper look).? The cut-to-size 18? x 30? panels come with coordinating edging and look like they could be installed in a matter of hours (with standard construction adhesive).? Each kit comes with 4 panels and covers 15 sf, or 10 linear foot. Plus, as the team in the booth heralded, aluminum offers the added conveniences of easy clean-up and no fingerprinting.

* Prest-on (http://prest-on.com/) ? A hardware geek like me couldn?t help but stop to see Prest-on.? While I have certainly seen their drywall clips in the past, I got a little geeky over the newest version of their Repair Kit.? Cracks in drywall can be addressed by slipping a repair clip (using a specially designed springy applicator tool) through the crack, eliminating the need of course to cut out the damaged area of drywall.? This product rounds out a suite of fasteners that also include the maker?s Insta-back repair clips, Corner-back corner clips and Framer-back blocking clips.

EnduraMax Wall Veneer System at the Remodeling Show* EnduraMax Wall Systems (http://enduramaxwallsystem.com/) ? First spotted at last year?s Show (but under a different name), EnduraMax took this year?s Product Hot Spot Innovative Product accolade.? This wall veneer system seems so easy at first glance.? I?d venture to even say that most diyers could now tackle? that type of project.? A proprietary foam grid is mounted directly to a substrate, and not only makes installation easier, but it actually offers true insulation value (R9-R13 depending on how you read it).? These unique panels stiffen the installation as whole, help manage moisture and provide improved overall energy efficiency.? Several brick-style and stone patterns are available, with more surely in the works.

* MoistureShield (http://www.moistureshield.com/) ? In the Deck Expo (as separate from the Remodeling Show), we found MoistureShield ? just one of more than a handful of exhibitors showing deck boards.? As a large stand-up in the booth pointed out, MoistureShield is, however, approved both for ground contact and can also be used in fully submersed situations. It is made of a composite material developed by A.E.R.T. ? a pioneer in recycling technologies.? Based in Arkansas, MoistureShield consists of approximately 95% recycled content and is made up of a 50?50 mix of plastics and (white/red) Knudsen Construction Aids at the Remodeling Showoak.? This product features a ?total encapsulation? technology and appears in two collections with 8 total available colors.

* Knudsen Construction Aids (no website and you must trust me that they were there) ? Finally! LEGOs for Building! I mean it ? Real Building and no lie, straight from Denmark ? yep! Sharing a small spot in the Expo with an under-decking drainage system (http://www.wahoodecks.com/), these little guys caught my eye.? It must have been the colors ?ooooo.? Don?t be fooled though those colors correspond with various thicknesses (still only in metric units though. Ugh!).? Spacers, Hangers, Wedges and Blocks are designed to lock and stay in place when they are screwed or nailed through.? Currently seeking US distribution perhaps you could get on board and help them fund a website or something.? Just sayin?.? Still, it sticks as a pretty decent idea ? with real potential.

*******

Back with another 10 sometime next week. Hope you enjoyed and thanks for reading. ~jb

WNYT.com - When breast cancer affects a woman in the beauty ...

By: Benita Zahn

"On your knees. It brings you to your knees."

??? Marri Aviza is talking about her battle with breast cancer.
????? ?
"Shocked. Am I gonna live. Am I gonna survive."

??? For 27 years she and business partner Lisa Norgrove have owned Rumors Salon in Loudonville.
??? They're dedicated to helping women both look good and live well. To that end the duo has raised a quarter of a million dollars for the Jane and Neil Golub breast health center in Niskayuna - from their annual breast cancer fundraising event.
??? It was a week after the fundraiser - November 5th, 2010 - Marri got her diagnosis. I came just as she and Norgrove started the construction project that would see their business move into a new building. With so many relying on her, Marri made an executive decision. She'd keep her diagnosis a secret to all but a close circle of friends and family.

"I think it would have made things worse for me, initially" she explains.
?? ?
???? She took about 8 weeks off to undergo a lumpectomy but worked while undergoing radiation and chemotherapy.
???? Now, two years healthy, she says it's time to talk - and support clients who are battling breast cancer; She knows she can bring something meaningful to them.

"I know exactly how dark those days can be" say Marri, adding, "I can really walk them through that whole journey."

?? Although she didn't take part in the American Cancer Society's 'look good, feel better program' she knows that attending to one's outward appearance during those dark days can help buoy you.?? ?

"Even on the darkest days I wanna say the days that I felt physically beaten downwards, I would get up and I would put on makeup and do my hair and I would get back in bed and I would feel better."
? ?
?? She's also ready to take her place with other survivors at Making Strides Against breast cancer. It'll be her first time at the walk

"And I think that now is my time to come out and get that support."

Making Strides takes place on October 21st at Albany's Washington Park.
